This paper analyses the intertwinement of legal philosophy and political theory in the British intellectual framework between the late 19th and early 20th centuries, with specific regard to Harold Laski's works. I will try to illustrate the transition from 19th-century utilitarianism to H. L. A. Hart and Isaiah Berlin as evolving through important debates which include Laski's contribution. I will argue that a discussion of “juridical” obligation, i.e., the conditions of legal validity, may lie implicitly in these concerns that Laski (...) and other early 20th-century British authors had about “political” obligation—viz., about the nature of the state and its claim to obedience. By approaching Laski's theories and their genealogy through a legal-philosophical perspective, I will contend that this debate about political obligation anticipates to a considerable extent some of the most renowned conceptions of obligation in 20th-century British legal theory. This article examines various models of legal interpretation and their implications for comparative law, drawing inspiration from Rodolfo Sacco’s early career theories. It contrasts the Tarskian Correspondence Model, which seeks objective reality in legal texts, with the Symphonic Model, which interprets legal language as a harmonious interplay of elements. The Tarskian model reflects classical legal thought’s search for fixed meanings, while the Symphonic model aligns with contemporary legal practice’s nuanced understanding. Further, the article explores Heraclitean Realism, acknowledging the fluidity of (...) language and meaning, and the Provocative Tapestry Model, which introduces paradox and tension in legal interpretation. These models are likened to narrative genres, offering varied approaches to understanding legal discourse: the Tarskian model as a detective novel, the Symphonic model as a comedy, the Living Tapestry model as a melodrama, and the Provocative Tapestry model as a tragedy. The article argues that these models of legal interpretation do not inherently carry a political essence; the political stance emerges from the choices of interpreters. It emphasizes the need for human agency in the application of legal norms and the responsibility of legal professionals to actively engage in the interpretation process. Comparative law is discussed as a discipline that benefits from understanding these diverse interpretative models, as it seeks to analyze legal systems across jurisdictions. The article concludes that while narrative styles in legal interpretation have political histories, they are not bound to specific ideologies, highlighting the versatility and subjectivity in the field of legal interpretation. Traditional Informed Consent is becoming increasingly inadequate, especially in the context of research biobanks. How much information is needed by patients for their consent to be truly informed? How does the quality of the information they receive match up to the quality of the information they ought to receive? How can information be conveyed fairly about future, non-predictable lines of research? To circumvent these difficulties, some scholars have proposed that current consent guidelines should be reassessed, with trust being used as (...) a guiding principle instead of information. Here, we analyse one of these proposals, based on a Participation Pact, which is already being offered to patients at the Istituto Europeo di Oncologia, a comprehensive cancer hospital in Milan, Italy. This contribution proposes to reflect on a different way of considering the link be-tween temporality and nature, between aiôn and physis, in dialogue with the words and works of the Italian sculptor Giuseppe Penone. The basic idea is the following: we will not be able to essentially determine our cognitive and experien-tial relationship with nature, until we are able to know, experience and represent the time inscribed in being itself. The philosophical tradition has developed its conception of temporality mainly (...) along two lines: a “cosmic” line, of a physical, objective temporality, and a “phenomenological” one, of a temporality as an in-ternal articulation of human consciousness. Through the archaeological and conceptual excavation carried out by Penone, we will ask ourselves what it does mean to take care of the “subjective time of things”. (shrink)

Neurodiversity has remained a controversial concept over the last decade. In its broadest sense the concept of neurodiversity regards atypical neurological development as a normal human difference. The neurodiversity claim contains at least two different aspects. The first aspect is that autism, among other neurological conditions, is first and foremost a natural variation. The other aspect is about conferring rights and in particular value to the neurodiversity condition, demanding recognition and acceptance. Autism can be seen as a natural variation on (...) par with for example homosexuality. The broad version of the neurodiversity claim, covering low-functioning as well as high-functioning autism, is problematic. Only a narrow conception of neurodiversity, referring exclusively to high-functioning autists, is reasonable. We will discuss the effects of DSM categorization and the medical model for high functioning autists. After a discussion of autism as a culture we will analyze various possible strategies for the neurodiversity movement to claim extra resources for autists as members of an underprivileged culture without being labelled disabled or as having a disorder. We will discuss their vulnerable status as a group and what obligation that confers on the majority of neurotypicals. (shrink)

Zea, discípulo de J. Gaos, se inspira en la tradición filosófica mexicana de Caso, Vasconcelos, Ramos, y va madurando su propia toma de conciencia acerca de la condición hispanoamericana. Así, se abre dialécticamente a la filosofía euro- pea, supera el nacionalismo ideológico mexicano de principios de mil (...) novecientos y llega hasta la filosofía de la liberación. De esta manera, la filosofía de Zea se adueña de las ideas de un humanismo cosmopolita en cuyo interior los individuos, los pueblos y las naciones toman conciencia de sus peculiaridades y saben abrirse a un pensamiento universal. The model presented in the target article includes feature processing and higher representations. I argue, based on neuropsychological evidence, that spatial representations are also involved in perceptual awareness of somatosensory events. Second, there is an asymmetry, with a right-hemisphere–based bilateral representation of the body. Third, the specific aspect of bodily awareness concerning motor function monitoring involves a network that includes the premotor cortex.

Traditional health sciences (including nursing) paradigms, conceptual models, and theories have relied heavily upon notions of the ‘person’ or ‘patient’ that are deeply rooted in humanistic principles. Our intention here, as a collective academic assemblage, is to question taken‐for‐granted definitions and assumptions of the ‘person’ from a critical posthumanist perspective. To do so, the cinematic works of filmmaker David Cronenberg offer a radical perspective to revisit our understanding of the ‘person’ in nursing and beyond. Cronenberg's work explores bodily transformation and (...) mutation, with the body as a fragile and malleable vessel. Cronenberg's work allows us to interrogate the body in all its complexity, contingency, and hybridity and provides avenues of rupture within current understandings of ‘the person’. Reinventing the definition of what it means to be human, critical posthumanism offers opportunities to both critique humanist theories and build affirmative futurities. Also drawing on the work of Deleuze and Guattari, specifically, their concept of becoming, we propose a critical posthumanist alternative to the conceptualization of the person in the health sciences, that of the becoming‐mutant, so frequently explored in Cronenberg's films. Such a conceptualization permits the inclusion of various technological interventions of the contemporary subject: The postperson. This position offers the health science disciplines a radical reconceptualization of the conceptual and theoretical approaches, extending beyond those trapped within the quagmire of humanistic principles. We offer a formal treatment of the semantics of both complete and incomplete mistrustful or distrustful information transmissions. The semantics of such relations is analysed in view of rules that define the behaviour of a receiving agent. We justify this approach in view of human agent communications and secure system design. We further specify some properties of such relations.

Dieses Buch befasst sich mit dem von Edmund Husserl in seinen Prolegomena zur reinen Logik unternommenen Versuch einer Beschreibung und Fundierung der reinen Logik und seiner Vereinbarkeit mit dem in der VI. Logischen Untersuchung behandelten Konzept der kategorialen Anschauung. Insbesondere geht es dabei um die Frage, ob die kategoriale Anschauung unter die in den Prolegomena vorgestellte Definition des spezifischen Relativismus subsumiert werden kann. Die Relevanz der Frage besteht darin, dass, wenn sie sich positiv beantworten ließe, eine Abweichung vom Antipsychologismus der (...) Prolegomena vorliegen würde. Der Autor argumentiert für die Vereinbarkeit des erwähnten theoretischen Konzepts mit dem Inhalt der Prolegomena. (shrink)

Reading 'Capital''s promotion of the Spinozist sources of Marxism has stimulated a series of important studies in several major zones of Marxist theoretical work. A more general reassessment of Spinoza's thought in the project of a 'radical Enlightenement' provides the opportunity to consider critically the contribution of these studies to the elaboration of Marxist political theory. Vittorio Morfino, well known Italian scholar of Spinoza and Althusser, proposes to study Engels's reading of Spinoza in the context of the inheritance of classical (...) German idealism in the Marxist theory of history. He argues that Spinoza provides resources for rethinking Marxist notions of temporality and structure. The result is a theory of conjunctural analysis, in distinction from 'normative' and 'prescriptive' perspectives. (shrink)

It is now generally accepted that the motor system is not purely dedicated to the control of behavior, but also has cognitive functions. Mirror neurons have provided a new perspective on how sensory information regarding others’ actions and gestures is coupled with the internal cortical motor representation of them. This coupling allows an individual to enrich his interpretation of the social world through the activation of his own motor representations. Such mechanisms have been highly preserved in evolution as they are (...) present in humans, apes and monkeys. Recent neuroanatomical data showed that there are two different connectivity patterns in mirror neuron networks in the macaque: one is concerned with sensorimotor transformation in relation to reaching and hand grasping within the traditional parietal-premotor circuits; the second one is linked to the mouth/face motor control and the new data show that it is connected with limbic structures. The mouth mirror sector seems to be wired not only for ingestive behaviors but also for orofacial communicative gestures and vocalizations. Notably, the hand and mouth mirror networks partially overlap, suggesting the importance of hand-mouth synergies not only for sensorimotor transformation, but also for communicative purposes in order to better convey and control social signals. Este artículo se centra en L'Alcorano di Macometto, escrito por Giovanni Battista Castrodardo de Belluno (1517 ca.-1588 ca.) e impreso por Andrea Arrivabene en Venecia en 1547. Aunque hoy sea considerado como una torpe paráfrasis de la traducción latina del Corán de Roberto de Ketton (1143 AD), un examen atento demuestra que L¿Alcorano costituyó una práctica y exitosa enciclopedia de bolsillo sobre la historia del islam y del Imperio otomano. Siguiendo una intuición de Alessandro D¿Ancona (1889), analizo los textos históricos (...) publicados en la introducción del texto, centrándome especialmente en la biografía del profeta Muh.ammad escrita por Castrodardo. Dicha biografía presenta una larga oración renacentista pronunciada por el monje Sergio-Bahi-ra- para convencer a Muh.ammad a derrocar al emperador Heraclio. A través de un análisis lingüistico y retórico detallado de esta oración, intento demostrar la cultura literaria de Castrodardo y su interés por las obras de Maquiavelo. Este nuevo retrato de Muhammad presenta al profeta del islam como un príncipe renacentista, un legislador y un «profeta armado», revelando asimismo las ideas políticas de los círculos filoturcos y anti-imperiales vinculados a la embajada de Francia en Venecia. In the current opinion paper, we provide a comparative perspective on specific aspects of primate empathic abilities, with particular emphasis on the mirror neuron system associated with mouth/face actions and expression. Mouth and faces can be very salient communicative classes of stimuli that allow an observer access to the emotional and physiological content of other individuals. We thus describe patterns of activations of neural populations related to observation and execution of specific mouth actions and emotional facial expressions in some species (...) of monkeys and in humans. Particular attention is given to dynamics of face-to-face interactions in the early phases of development and to the differences in the anatomy of facial muscles among different species of primates. We hypothesize that increased complexity in social environments and patterns of social development have promoted specializations of facial musculature, behavioral repertoires related to production and recognition of facial emotional expression, and their neural correlates. In several primates, mirror circuits involving parietal-frontal regions, insular regions, cingulate cortices, and amygdala seem to support automatic forms of embodied empathy, which probably contribute to facial mimicry and behavioural synchrony. In humans these circuits interact with specific prefrontal and temporo-parietal cortical regions, which facilitates higher order cognitive functions such as cognitive empathy and mental state attribution. Our analysis thus suggests that the evolution of higher forms of empathy, such as mentalizing, is also linked to the coupling between the perceptual and motor system related to face processing, which may have undergone a process of exaptation during primate phylogeny. The foundation of Mathematics is both a logico-formal issue and an epistemological one. By the first, we mean the explicitation and analysis of formal proof principles, which, largely a posteriori, ground proof on general deduction rules and schemata. By the second, we mean the investigation of the constitutive genesis of concepts and structures, the aim of this paper. This “genealogy of concepts”, so dear to Riemann, Poincaré and Enriques among others, is necessary both in order to enrich the foundational analysis (...) with an often disregarded aspect (the cognitive and historical constitution of mathematical structures) and because of the provable incompleteness of proof principles also in the analysis of deduction. For the purposes of our investigation, we will hint here to a philosophical frame as well as to some recent experimental studies on numerical cognition that support our claim on the cognitive origin and the constitutive role of mathematical intuition. As biological and biomedical research increasingly reference the environmental context of the biological entities under study, the need for formalisation and standardisation of environment descriptors is growing. The Environment Ontology (ENVO) is a community-led, open project which seeks to provide an ontology for specifying a wide range of environments relevant to multiple life science disciplines and, through an open participation model, to accommodate the terminological requirements of all those needing to annotate data using ontology classes. In their 2002 seminal paper Hauser, Chomsky and Fitch hypothesize that recursion is the only human-specific and language-specific mechanism of the faculty of language. While debate focused primarily on the meaning of recursion in the hypothesis and on the human-specific and syntax-specific character of recursion, the present work focuses on the claim that recursion is language-specific. We argue that there are recursive structures in the domain of motor intentionality by way of extending John R. Searle’s analysis of intentional action. We (...) then discuss evidence from cognitive science and neuroscience supporting the claim that motor-intentional recursion is language-independent and suggest some explanatory hypotheses: linguistic recursion is embodied in sensory-motor processing; linguistic and motor-intentional recursions are distinct and mutually independent mechanisms. Finally, we propose some reflections about the epistemic status of HCF as presenting an empirically falsifiable hypothesis, and on the possibility of testing recursion in different cognitive domains. Nel pensiero politico di Ralf Dahrendorf un tema ricorre costantemente, sia che si tratti di liberalismo sia della democrazia rappresentativa: le costituzioni politiche sono radicate nelle strutture sociali, stato politico e stato sociale sono mutualmente interdipendenti. In assenza di specifiche strutture sociali, la democrazia rappresentativa non può divenire effettiva, e quindi corrispondere a una realtà evidente perfettamente valutabile. Ancora. Le strutture sociali pongono limiti molto ristretti all’effettività delle forme politiche. Esistono, in altri termini, precisi elementi strutturali che permettono l’oggettivazione della (...) democrazia liberale, e non altri. Si tratta certo di una concezione che deve molto a Tocqueville, la sua immagine illumina il pensiero dahrendorfiano sulla democrazia. Pur tuttavia non è l’unico elemento ricorrente. Ideale e reale qui si confrontano. L’idea di democrazia, infatti, si misura con la realtà sul terreno della prassi politica. Non a caso Ralf Dahrendorf è presente in quattro diversi parlamenti in cui ha visto all’opera il cambiamento senza violenza, l’argomentazione razionale, l’espressione della maggioranza e il controllo del governo. Non si tratta solo dei princìpi fondamentali della teoria politica democratica, ma anche della sua formula politica, con la quale interpreta i cambiamenti negli spazi politici globali. Si tratta di spazi nei quali il potere è libero da vincoli, si misura sulla base di rapporti di forza, non conosce regole e procedure se non quelle dell’economicismo, della tecnica, della finanziarizzazione. Tuttavia lo Stato nazionale e la democrazia parlamentare sono ancora decisivi. Proprio perché pensa questo, egli crede che nello spazio globale i principi della democrazia rappresentativa devono essere tradotti in realtà. Certo, Dahrendorf non è in grado di indicare nuove soluzioni, ma si limita a mostrare delle semplici proposte per gestire il dibattito pubblico nel passaggio da una democrazia classica ad una «nuova democrazia». The reaction of Italian physicists to the innovations of the ‘new physics’ has been studied by analysing their scientific production and their textbooks. Their stand appears to have been the result of several components: absence or weakness of lines of research in the last three decades of the nineteenth century ; firm attachment to the conceptual and philosophical foundations of classical mechanics; and hostility to the quantization of energy. Focused sequent calculi are a refinement of sequent calculi, where additional side-conditions on the applicability of inference rules force the implementation of a proof search strategy. Focused cut-free proofs exhibit a special normal form that is used for defining identity of sequent calculi proofs. We introduce a novel focused display calculus fD.LG and a fully polarized algebraic semantics FP.LG\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\mathbb {FP.LG}$$\end{document} for Lambek–Grishin logic by generalizing the theory of multi-type calculi and their (...) algebraic semantics with heterogenous consequence relations. The calculus fD.LG has strong focalization and it is sound and complete w.r.t. FP.LG\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\mathbb {FP.LG}$$\end{document}. This completeness result is in a sense stronger than completeness with respect to standard polarized algebraic semantics, insofar as we do not need to quotient over proofs with consecutive applications of shifts over the same formula. LG-algebras: this amounts to a semantic proof of the so-called completeness of focusing, given that the standard (display) sequent calculus for Lambek–Grishin logic is complete w.r.t.
